New York State Police responded to Oak Road in the town of Cortlandt on Tuesday, Feb. 5 at approximately 8:15 p.m. on the report of a physical domestic dispute.
Further investigation revealed that Howard J. Powley of Cortlandt had choked the victim and then prevented an emergency call for help. Powley then allegedly released the victim, who ran out of the residence.
Outside, Powley proceeded to menace the victim before smashing a lawn ornament on the victim’s vehicle.
Powley was arrested and charged with the following class A misdemeanors:
- Criminal obstruction of breathing
- Second-degree menacing
- Fourth-degree criminal possession of a weapon
- Fourth-degree criminal mischief
Powley was arraigned before the town of Cortlandt Court and released on his own recognizance. A temporary order of protection was also requested, and granted, on behalf of the victim.
